Terms and Conditions of Consent for User-Generated Content (UGC)
By agreeing to let us use your content by replying “Yes” to the direct message from @derwentartofficial on Facebook or Instagram, you acknowledge that you have read, understood, and agree to the following terms and conditions.
- Eligibility You confirm that you are at least 18 years old.
- Ownership and Rights You confirm that you are the sole creator and rights holder of the content you are submitting, or you have obtained express, written consent from any co-creators, and that your content does not infringe on any third-party rights, including copyrights, trademarks, or rights of privacy.
- Consent to Use
o You grant Derwent and its affiliated companies a non-exclusive, royalty-free, revocable, worldwide license to use, reproduce, display, distribute, and adapt your content for marketing purposes in the UK and Europe. This includes usage on official social media accounts, websites, emails, and paid advertising.
o You may revoke this license at any time by contacting derwent.pencils@acco.com. We will cease new uses upon receipt of your revocation and remove content from live campaigns within a reasonable time.
o You permit minor modifications to your content for formatting or clarity (e.g., resizing, cropping, minor colour adjustments) provided such changes do not misrepresent or distort the original content or harm your reputation.
o We may obscure visible logos, trademarks, or brand names in your content, where required.
o You agree that we may, at our discretion, credit you by tagging your social media handle or name. If you do not wish to be credited, please indicate this in writing.
4. Respect for Moral Rights We will:
o Not modify your content in a derogatory or misleading manner;
o Not use your content in contexts that could harm your honour or reputation;
o Use your content respectfully and in alignment with your consent.
5. Data Protection
o By submitting your content, you consent to the processing of your personal data (including name, handle, image, and content) by Derwent for the purposes of using and sharing your content in promotional material.
o You understand that you may withdraw your consent and request deletion of your personal data or removal of your content at any time by contacting
DataPrivacy@acco.com.
o Your personal data will be handled in accordance with applicable data protection laws, including the GDPR. Our full privacy policy is available at

6. Indemnity You agree to indemnify and hold harmless Derwent, its affiliates, and their officers, employees, and agents from any and all claims, damages, or legal actions arising out of your content or your breach of these terms.
7. No Obligation to Use We reserve the right not to use or to remove any submitted content at our sole discretion.
8. Governing Law These terms are governed by the laws of England and Wales, without prejudice to any mandatory consumer protection laws in your country of residence.
